BY EVAN THOMAS ANCHOR BLAKE HANSON Apple can add another potential lawsuit to its stack: the US Justice Department says it's prepared to sue Apple and book publishers for colluding to inflate e-book prices, thus violating antitrust laws. According to the Wall Street Journal, the Justice Department is taking issue with the agency model that Apple brought onto the e-book scene. Before the iPad and other e-readers, publishers used to sell books for cheap to physical retailers like Borders and Barnes & Noble. "Traditionally, publishers sold books to retailers for roughly half of the recommended cover price. Under that 'wholesale model,' booksellers were then free to offer those books to customers for less than the cover price if they wished. Most physical books are sold using this model." Amazon took it a step further. When it was building up its market lead with the Kindle, it introduced a loss-leader model and sold e-books for even less than wholesale price. Publishers didn't like losing out, and The Justice Department alleges they went to Apple to put a stop to Amazon's tactics. Under Apple's model, publishers set a book's end price and Apple takes a 30% cut. Forbes points out there are problems with both sales models. All's fair in love and business, until the authorities step in. Samsung is feeling the corporate sting today in Europe, where the company's battle with Apple for the hearts and minds of tablet consumers has resulted in an antitrust inquiry by the European Union. EU watchdogs believe the South Korean company may be using lawsuits over 3G wireless technology to hinder competitors from selling their own products, including Apple. The company may not be giving companies fair access to patents it holds on 3G, which is used in many mobile devices, even though it said it would do so in 1998. The other bad news for Samsung? The company also just lost in a German appeals court, in a case that will prevent sales of some versions of Samsung's Galaxy Tab, because it looks too much like the iPad. Hey, it could be worse, Samsung. At least you're not trying to hawk the Blackberry playbook.

Bloomberg reports that Intel (INTC), FTC to settle antitrust case... the Los Angeles Times reports that Time Warner Cable (TWC) is reportedly considering whether to "roll over or get tough" on network demands for higher fees from Disney (DIS), which owns ABC and ESPN. The Globe and Mail is reporting that Xstrata (XSRAY) CEO Mick Davis says the company would be open to a deal with a commodities company like Glencore International if it can add "considerable value" to its shareholders. The company hasn't received a merger or takeover proposal from Glencore, but the says the two have held discussions...and finally, the Wall Street Journal reports that Americans are spending more on electronics and less on durable goods, according to Commerce Department data.

The Wall Street Journal reports, BlackRock is planning to launch a trading platform this year that would let the world's largest money manager and its peers bypass Wall Street and trade bonds directly with one another. Under the plan, the platform would seek to match buyers and sellers of the same securities, in a process known as "crossing trades." BlackRock Solutions would charge a small fee for the service that would be much lower than Wall Street's trading commissions. Some of the transactions would effectively cut out the Wall Street dealers that have long acted as middlemen in the credit markets. BlackRock's asset business, which oversees $3.5 trillion, would also use the platform. The Wall Street Journal also reports, The US accused Apple and five of the nation's largest publishers Wednesday of conspiring to raise e-book prices, in a case that could radically reorder the fast-growing business. In a civil antitrust lawsuit, the Justice Department alleged that CEOs of the publishing companies met regularly in private dining rooms of upscale Manhattan restaurants to discuss how to respond to steep discounting of their e-books by Amazon.com. According to Attorney General Eric Holder: "As a result of this alleged conspiracy, we believe that consumers paid millions of dollars more for some of the most popular titles."
